Definition: To establish a claim or allegation by admissible evidence (what the court will allow or is permissible by law) is known as the “burden of proof.” In simplest terms the burden of proof is required evidence to establish a basis for filing legal action with a court.
The burden of proof in a civil case is usually on the plaintiff (the person or entity filing the complaint).
The burden of proof in a criminal case is always the duty of the state.
