ERISA laws make it tough to sue managed care, however, several precedent setting cases have been argued successfully, including one in the U.S. Supreme Court.
Under ERISA you cannot be denied coverage for a pre-existing medical condition but your benefits canbe limited. ERISA caps the maximum period that a plan can exclude coverage for a pre-existing condition to no more than twelve (12) months.
