ERISA laws regulate and set standards for benefits offered by employers. But if an insurance or other plan fails you, and you suffer damages or someone dies, you cannot recover damages. ERISA laws make it tough to sue managed care, however, several precedent setting cases have been argued successfully, including one in the U.S. Supreme Court.
Under ERISA you cannot be denied coverage for a pre-existing medical condition but your benefits canbe limited. ERISA caps the maximum period that a plan can exclude coverage for a pre-existing condition to no more than twelve (12) months.
